Terms of Service

By using our website, submitting a form, requesting a quote, booking an appointment, or opting into our messaging, you agree to these Terms. If you do not agree, do not use the Services.

1. Acceptance of terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. Black Optix Tint West Haven is part of the Black Optix Tint franchise network and is independently owned and operated by RPMenlove Tint LLC under a franchise agreement with BOT Franchising, LLC, which operates the Black Optix Tint brand website where our location page and online booking are hosted. These Terms govern our services and our text messaging program. Your use of the Black Optix Tint brand website itself is also subject to our franchisor's Terms and Conditions, available at blackoptixtint.com/terms-and-conditions, and our franchisor's privacy policy, available at unitedfranchisegroup.com/trust/privacy-policy. If our franchisor's terms conflict with these Terms on our services, appointments, quotes, or text messages, these Terms control.

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) to use the Services and to consent to our messaging programs. The Services are not directed to children.

3. Our services

RPMenlove Tint LLC provides services and related products as described on our location page. We offer the ability to request quotes, book appointments, and communicate with us. Specific services, availability, and pricing may change at any time.

4. Quotes, estimates, and appointments

Quotes and estimates provided through the website or by message are for informational purposes, are not guaranteed, and may be subject to inspection, availability, and final confirmation. Booking a requested appointment time is subject to our confirmation. Payment is due at the time of service unless a deposit is collected when you book. Any deposit is collected through our point-of-sale system. If a deposit is required, its amount and its cancellation and refund terms will be shown to you before you pay, and the deposit is applied to your final invoice. Paying a deposit never requires you to agree to marketing messages, and you can book and pay a deposit by phone or in person if you do not want to receive texts.

Cancellations and no-shows. We ask that you give us reasonable advance notice if you need to cancel or reschedule an appointment. We may decline to rebook or may apply a fee for repeated missed appointments, as communicated to you at the time of booking.

Promotions and offers. Any promotions, discounts, or special offers we advertise are subject to their stated terms and any conditions we disclose (such as eligibility, expiration dates, and limits). Offers may not be combined unless we say so, may be changed or withdrawn at any time, and are never conditioned on agreeing to receive marketing messages.

5. Text messaging (SMS) program terms

By providing your mobile number or opting in, you agree to these messaging terms.

• Program description. RPMenlove Tint LLC sends (a) transactional messages about your appointments, quotes, and service updates, and (b) - only if you separately opt in - marketing messages such as promotions, offers, and discounts. All messages come from Black Optix Tint West Haven; our franchisor does not send messages under this program.
• Consent. You may opt in in several ways, including but not limited to: by submitting a form on our website; by texting us first, including texting a keyword to one of our numbers; by calling or texting any of our phone lines, including our shop phone or a member of our team; by messaging us on social media (such as Facebook or Instagram) or by email and giving us your mobile number; or in person. Our quote and booking request forms require a phone number so a team member can appropriately contact you, and submitting one of these forms constitutes consent to transactional messages about that quote, appointment, or service. If you contact us by phone, text, social media message, email, or in person and give us your mobile number for a quote, appointment, or service, you consent to receive text messages from us about that request. If you do not wish to receive text messages, you can call us at (801) 340-9970 or visit us in person at 1972 W 2550 S Suite D, West Haven, UT 84401 to get a quote or book an appointment instead. Texting is never required to receive a quote or service. Marketing messages require a separate, optional opt-in and are never a condition of any purchase.
• Message frequency. Frequency varies depending on your interactions with us and, if opted in, ongoing promotions. Messages may be sent using automated technology.
• Costs. Message and data rates may apply, depending on your mobile plan and carrier.
• Opt out. Reply STOP to any message to unsubscribe. You will receive one final message confirming you have been unsubscribed. You may continue to receive transactional messages about a service you have actively requested.
• Help. Reply HELP for assistance, or contact us at (801) 340-9970 or info@westhavenut.blackoptixtint.com.
• Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
• Eligibility. You represent that you are the account holder or authorized user of the mobile number you provide.
• No sharing. Your mobile number and text message consent are never shared with or sold to third parties or affiliates for their marketing or promotional purposes.

6. Electronic communications, call recording, and automated/AI interactions

By using the Services, you consent to receive communications from us electronically (by text or email, consistent with your consent choices), and you agree that electronic communications satisfy any legal requirement that communications be in writing.

We may record or monitor phone calls with you for quality, training, and recordkeeping purposes. Where the law requires notice or consent, we will inform you at the start of the call, and by continuing the call you consent to the recording.

Some communications - including text messages and any chat feature on our website - may be handled by automated systems, by artificial intelligence (which may use third-party providers to process your messages), by our staff, or by a combination of these, and a single conversation may move between them. Automated and AI-generated responses may not always be accurate, do not constitute professional advice, and should not be relied upon as such. Any price, quote, estimate, availability, or appointment time provided by an automated or AI system is not a binding offer and is subject to our confirmation. 7. Acceptable use

You agree not to misuse the Services, including by: violating any law; submitting false information or another person's information without authorization; attempting to interfere with or disrupt the website; or using the Services for any fraudulent or unlawful purpose. We may suspend or end your access to the Services if you violate these Terms.

8. Intellectual property

The Black Optix Tint name, logos, trademarks, and brand website content are owned by BOT Franchising, LLC or its licensors and are used by us under license. Content we provide is owned by RPMenlove Tint LLC or its licensors. All of it is protected by intellectual property laws. You may not copy, reproduce, or use it without permission.

9. Third-party links and services

Our website may contain links to third-party websites or services we do not control. We are not responsible for their content, policies, or practices.

10. Disclaimers

The Services and website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure. The brand website is operated by our franchisor, and we are not responsible for its availability or operation. Any separate written warranty we provide for specific products or services is governed by that warranty's own terms.

11. Limitation of liability

To the fullest extent permitted by law, RPMenlove Tint LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless RPMenlove Tint LLC and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or violation of these Terms.

13. Dispute resolution - binding arbitration and class-action waiver

Please read this section carefully - it affects your legal rights.

Before filing any claim, you agree to first contact us at info@westhavenut.blackoptixtint.com or (801) 340-9970 and try to resolve the dispute informally. If we can't resolve it within 30 days, either party may proceed as described below.

Any dispute or claim arising out of or relating to these Terms, the Services, or any messages you receive from us (including claims under the Telephone Consumer Protection Act) will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court.

Class-action waiver. You and RPMenlove Tint LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Process. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and will take place in Weber County, Utah, or via remote/written proceedings where available. The arbitrator's decision is final and binding.

Right to opt out of arbitration. You may opt out of this arbitration agreement by sending written notice to info@westhavenut.blackoptixtint.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.

If this arbitration agreement is found unenforceable, the class-action waiver will remain in effect to the extent permitted by law.

14. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Subject to Section 13, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Weber County, Utah.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date, and your continued use of the Services after changes take effect constitutes acceptance.

Website domain and URL changes. We may change our website domain name, URLs, or page paths (slugs) at any time. When we make these changes, our technical team will implement appropriate redirects and update website navigation and policy links to maintain access to our Services and provide continuity of the user experience. These Terms continue to govern your use of the Services at any replacement domain or URL.

The current versions of our Privacy Policy and Terms of Service are available at blackoptixtint.com/locations/ut/west-haven/privacy-policy and blackoptixtint.com/locations/ut/west-haven/terms-of-service, and through our website navigation.

16. Severability and entire agreement

If any provision of these Terms is held invalid, the remaining provisions will remain in full effect. These Terms and our Privacy Policy are the entire agreement between you and RPMenlove Tint LLC regarding the Services, except that your use of the Black Optix Tint brand website is also subject to our franchisor's terms as described in Section 1. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
