Privacy Policy

By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.

1. Who we are

Black Optix Tint Franklin is part of the Black Optix Tint franchise network. We are independently owned and operated by McKeown Group LLC under a franchise agreement with BOT Franchising, LLC, the Black Optix Tint franchisor and a United Franchise Group brand. Our franchisor operates the Black Optix Tint brand website, where our location page and online booking are hosted. Our franchisor's privacy policy (unitedfranchisegroup.com/trust/privacy-policy) covers your general use of that website, including cookies. This Policy covers the information you submit to Black Optix Tint Franklin through our booking and quote forms. If our franchisor's privacy policy conflicts with this Policy on information you submit through our booking and quote forms, including your mobile phone number and text messaging consent, this Policy controls.

McKeown Group LLC is a Tennessee-based business. For privacy questions or to exercise your rights, contact us at info@franklintn.blackoptixtint.com or (615) 645-3387.

2. Information we collect

Information you provide to us. When you fill out a form, request a quote, book an appointment, or contact us, we may collect:

• Your name
• Your mobile phone number
• Your email address
• Vehicle information (such as make, model, and year)
• The service or package you select or inquire about
• Any other information you choose to provide in messages or notes

Information from phone calls. If you call us or we call you, we may record or monitor the call for quality, training, and recordkeeping purposes. Where required by law, we will notify you at the start of the call, and by continuing the call you consent to the recording.

Information collected automatically. When you visit our page on the Black Optix Tint brand website, our franchisor, we, and our service providers may automatically collect:

• Device and browser type, operating system, and language
• IP address and general location (city/region level)
• Pages viewed, links clicked, time on site, and referring URLs
• Information collected through cookies and similar technologies (see Section 5)

If you pay a deposit or other payment online, it is collected and processed through our point-of-sale system. Neither we nor our franchisor store your full card number.

3. How we use your information

We use the information we collect to:

• Respond to your quote requests, inquiries, and appointment bookings
• Send you transactional text messages and emails about your appointments, quotes, and services (see Section 4)
• Send you marketing messages if you have opted in (see Section 4)
• Operate, maintain, and improve our website and Services
• Measure and improve our advertising and marketing (see Section 6)
• Comply with legal obligations and protect our rights

4. Text messaging (SMS) and your consent

We offer text messaging, and you may opt in in several ways, including but not limited to: by submitting a form on our website; by texting us first, including texting a keyword to one of our numbers; by calling or texting any of our phone lines, including our shop phone or a member of our team; by messaging us on social media (such as Facebook or Instagram) or by email and giving us your mobile number; or in person at our location. When you opt in through our website, the required disclosures appear on the form. Whichever way you opt in, our first text message to you identifies us and explains how to opt out.

Transactional messages. Our quote and booking request forms require a phone number so a team member can appropriately contact you. When you submit one of these forms, or otherwise provide your phone number to book an appointment or request a quote, you consent to receive text messages from us about that quote, appointment, and related service updates. If you contact us by phone, text, social media message, email, or in person and give us your mobile number for a quote, appointment, or service, you consent to receive text messages from us about that request. If you do not wish to receive text messages, you do not need to use these forms: you can call us at (615) 645-3387 to get a quote or book an appointment by phone, or visit us in person at 92 Confederate Dr, Franklin, TN 37064. Texting is never required to receive a quote or service.

Marketing messages. We send promotional texts (offers, discounts, and updates) only to people who separately and voluntarily opt in by checking the marketing consent box. Marketing consent is never a condition of purchasing any product or service.

For all messages: messages may be sent using automated technology, message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Opting out of marketing messages will not stop transactional messages related to a service you have requested.

We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing purposes. Your text-messaging consent will not be shared with any third parties except subcontractors or service providers (such as our messaging platform) acting on our behalf to deliver the messaging service, and those parties are contractually prohibited from using the information for any other purpose. Our franchisor operates the brand website, so your booking or quote request passes through its systems first and it receives a copy as part of delivering your request to us and to other systems used across the Black Optix Tint franchise network. It does not use your mobile phone number to send you marketing text messages unless you separately opt in to marketing texts from our franchisor.

Automated, AI-assisted, and staff communications. Our communications - including text messages and any chat feature on our website - may be handled by automated systems, by artificial intelligence tools (including tools provided by third-party service providers), by our staff, or by a combination of these, and a single conversation may move between them. When you message us or use our chat feature, your messages may be processed and stored by us and those providers to operate the service, respond to you, and improve our support. By using these features, you consent to this processing. Automated and AI systems may not always be accurate; see our Terms of Service for details on automated responses.

5. Cookies and tracking technologies

We use cookies, pixels, tags, and similar technologies to operate the website, remember your preferences, understand how the site is used, and support advertising. You can usually control cookies through your browser settings; disabling some cookies may affect how the site works.

The Black Optix Tint brand website is operated by our franchisor, which manages the cookie notice and cookie settings on that site. Analytics and advertising cookies may run when you arrive. You can opt out at any time with the “Do Not Sell or Share My Personal Information” link in the cookie notice or the site footer. We honor Global Privacy Control (GPC) signals as a request to opt out of non-essential cookies, to the extent our systems support them.

6. Analytics and advertising

We work with analytics and advertising providers - including social media and search platforms such as Meta, Google, TikTok, and LinkedIn - that use cookies, pixels, tags, and similar technologies (including server-side connections) to help us measure website activity, understand how our Services are used, and deliver and measure advertising. These providers may collect information about your activity on our pages of the Black Optix Tint brand website over time and across other websites and services, and may combine it with information they already hold.

To learn how these providers handle your information, see their privacy policies: Meta (facebook.com/privacy/policy), Google (policies.google.com/privacy), TikTok (tiktok.com/legal/page/us/privacy-policy/en), and LinkedIn (linkedin.com/legal/privacy-policy). We may use other or additional providers from time to time.

These activities may constitute "sharing" or processing of your information for targeted advertising as defined under certain state privacy laws. See Section 11 for how to opt out. You can also opt out of many interest-based ads through the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org), and through the settings offered by the advertising and social-media platforms you use.

7. How we share information

We do not sell your personal information for money. We may share information:

• With service providers who perform services for us (such as our CRM and messaging platform, email provider, website host, point-of-sale and payment provider, and analytics/advertising partners), under contracts limiting their use of the information.
• Within the Black Optix Tint franchise network: with our franchisor, BOT Franchising, LLC, which operates the brand website and booking pages. Your booking or quote request passes through its systems first, so it receives a copy as part of delivering your request to us and to other systems used across the Black Optix Tint franchise network, and also uses it to track bookings and support our location. Our franchisor may use your name and email address for Black Optix Tint brand email promotions, which you can unsubscribe from at any time using the link in any email. As stated in Section 4, it does not use your mobile phone number to send you marketing text messages unless you separately opt in to marketing texts from our franchisor.
• With our point-of-sale provider, to record and complete the services you purchase and to process any deposit.
• For legal reasons, if required by law or to protect the rights, safety, or property of McKeown Group LLC, our customers, or others.
• In a business transfer, such as a merger, acquisition, or sale of assets.

As stated in Section 4, SMS opt-in data is never shared for third-party or affiliate marketing.

8. Email communications

If you receive marketing emails from us, you can unsubscribe at any time using the link in any email. We will honor opt-out requests promptly. Transactional emails about your appointments or services may continue.

9. Data retention

We keep personal information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. We retain records of messaging consent for at least the period required to demonstrate compliance.

10. Data security

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

11. Your privacy rights

Depending on where you live, you may have rights under laws such as the California Consumer Privacy Act (CCPA/CPRA), the Tennessee Information Protection Act (TIPA), and other state privacy laws. These may include the right to:

• Know or access the personal information we hold about you
• Correct inaccurate information
• Delete your information
• Obtain a portable copy of your information
• Opt out of targeted advertising and of any "sale" or "sharing" of your information

Do Not Sell or Share / Opt out of targeted advertising. To opt out of the advertising-related sharing described in Section 6, use the “Do Not Sell or Share My Personal Information” link in the cookie notice or the site footer, or contact us at info@franklintn.blackoptixtint.com and we will honor your request, and you can use the browser and ad-industry opt-out tools listed in Section 6. Where required by applicable law, we also honor recognized browser-based opt-out preference signals (such as the Global Privacy Control) to the extent our systems support them.

No financial incentives. We do not offer financial incentives or charge different prices in exchange for the collection, retention, sale, or sharing of your personal information. Any promotions or discounts we advertise are available on their stated terms and are not conditioned on your agreeing to receive marketing messages.

To exercise any of these rights, contact us at info@franklintn.blackoptixtint.com or (615) 645-3387. We will verify your request and respond as required by law. You may also have the right to appeal a decision or to lodge a complaint with your state attorney general. We will not discriminate against you for exercising your rights.

12. Children's privacy

Our Services are intended for adults 18 and older and are not directed to children. We do not knowingly collect personal information from children under 13, and our messaging programs are not directed to anyone under 18. If you believe a child has provided us information, contact us and we will delete it.

13. Third-party links

Our website may link to third-party sites we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices.

14. Changes to this Policy

We may update this Policy from time to time. We will post the updated version with a new effective date, and material changes will be communicated as required by law.

Website domain and URL changes. We may change our website domain name, URLs, or page paths (slugs) at any time. When we make these changes, our technical team will implement appropriate redirects and update website navigation and policy links to maintain access to our Services and provide continuity of the user experience. This Privacy Policy continues to apply to the Services at any replacement domain or URL.

The current versions of our Privacy Policy and Terms of Service are available at blackoptixtint.com/locations/tn/franklin/privacy-policy and blackoptixtint.com/locations/tn/franklin/terms-of-service, and through our website navigation.
